These Terms of Service ("Terms") govern your use of the EatSafe Japan service ("Service") provided by the operator ("Company"). By using this Service, you agree to these Terms. IF YOU DO NOT AGREE TO THE TERMS, YOU MUST IMMEDIATELY DISCONTINUE USE OF THE SERVICE.
This Service is available to individuals who are 18 years of age or older. By using this Service, you represent that you meet this age requirement.
EatSafe Japan provides a digital food allergy and dietary restriction card ("Card") designed to assist users in communicating their dietary needs to restaurant staff in Japan. The Card is a communication assistance tool only. It is generated based on user-provided information and displayed in Japanese. The Service does not guarantee that restaurants will fully understand or accommodate all dietary requirements. The Card is not a medical document, diagnosis, or certification of any kind.
The Service and the Card are NOT a substitute for medical or other professional advice. By using the Service, you represent and warrant that you have obtained appropriate medical and professional advice regarding your food allergies, intolerances, or dietary restrictions. If you are unsure of the nature or severity of your food allergy or intolerance, you should consult a medical professional. The Company does not provide medical, dietary, nutritional, or health advice of any kind.
The Company, including its agents, affiliates, suppliers, directors, and employees, is in NO WAY liable for personal injury, illness, or death arising from a food allergy, intolerance, or dietary restriction. There is an inherent risk in consuming food if you have a food allergy, and the Card cannot be expected to fully eliminate such risk. The Company provides no guarantee that the Card will fully communicate your food allergy or dietary restriction to the reader, as the effectiveness of communication depends on several factors outside the Company's control, including but not limited to: (a) the language ability and literacy of the reader; (b) the reader's understanding of food allergies as a serious health concern; (c) the food safety practices of the establishment; (d) your own verbal communication with restaurant staff; (e) regional variations in ingredient names and cooking methods.
You represent and warrant that you will take personal precautions above and beyond the Card to ensure your health and safety, including but not limited to: carrying life-saving medicine (such as an epinephrine auto-injector) at all times, being accompanied by someone who can assist in an emergency, knowing how to contact local emergency services, and verbally confirming food safety with restaurant staff. You acknowledge and agree that the Card, when used in isolation without other health and safety measures, is an insufficient safeguard for your food allergy, intolerance, or dietary restriction.
While the Company strives to provide accurate translations, due to factors such as regional dialects, cultural differences, and the evolving nature of language, food translation is not an exact science. The Company does not guarantee the accuracy, completeness, or effectiveness of any translated content on the Card. Users should not rely solely on the Card and should take additional steps to confirm food safety.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. The Company does not warrant that the Service will be uninterrupted, error-free, or secure.
The Service requires a one-time payment of ¥1,650 (tax included) for a 30-day access period, or ¥3,300 (tax included) for a 1-year access period. Payment is processed through Stripe. Once payment is completed, the Service becomes available immediately. The access period begins from the date of payment.
To the maximum extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including without limitation personal injury, illness, death, economic loss, or any other damages arising from or related to your use of the Service or the Card. The Company's total liability shall not exceed the amount paid by the user for the Service.
You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, agents, and affiliates from and against any and all claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the Service; (b) your breach of these Terms; (c) any inaccuracy in the information you provided; (d) any claim by a third party related to your use of the Card.
The Company shall not be liable for any failure or delay in performing its obligations due to circumstances beyond its reasonable control, including but not limited to natural disasters, system failures, cyberattacks, internet outages, pandemics, or governmental actions.
The Company may suspend or terminate your access to the Service at any time if you violate these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including disclaimers, limitations of liability, and indemnification.
The Company reserves the right to modify these Terms at any time. Users will be notified of significant changes. Continued use of the Service after changes constitutes acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of Japan. Any disputes shall be subject to the exclusive jurisdiction of the Tokyo District Court.
